In return for the opportunity to participate in the Mobil Delvac Fall CVL Sweepstakes described herein (the "Sweepstakes"), ExxonMobil Oil Corporation ("EMOC" or "Sponsor") requires your agreement to comply with and be bound by the terms and conditions set forth below (the "Official Rules").
NO PURCHASE NECESSARY TO ENTER OR WIN THE SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
Participation constitutes entrant's full and unconditional agreement to, and acceptance of, these Official Rules (these "Official Rules"). The Mobil Delvac™ 2023 Fall CVL Sweepstakes (the "Sweepstakes") begins at 12:00:01 AM Central Standard Time ("CST") on September 1, 2023 and ends at 11:59:59 PM CST on November 30, 2023 and all entires must be sumbitted by 11:59:59 PM CST on November 30, 2023 (the "Promotion Period"). Sweepstakes is sponsored by ExxonMobil Oil Corporation, 22777 Springwoods Village Pkwy, Spring, TX 77389 (the "Sponsor") and is administrated by Don Jagoda Associates, Inc., 100 Marcus Drive, Melville, NY 11747 (the "Administrator").
ELIGIBILITY: Sweepstakes is open to all legal residents of the fifty (50) United States and the District of Columbia who have reached the age of majority in his or her state or territory of residence and are at least 18 years of age or older as of September 1, 2023, and who fulfill the requirements for the Sweepstakes as set forth herein below ("Entrant"). Void where prohibited or restricted by law, rule or regulation.
Employees, officers, and directors [including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related] of the Sponsor, the other Promotion Entities (as defined below) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, employees or officials of any government, or government-owned or government-controlled entity, that has regulatory authority over Exxon Mobil Corporation or any of its affiliates and any and all other companies associated with the Sweepstakes are not eligible to participate or win, as detailed below.
Participants in this Sweepstakes agree to be bound by these Official Rules and agree that EMOC and their designees and assigns may use the participant's name, voice, city/state of residence, photos, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification.
The "Promotion Entities" shall mean organizations directly involved with this Sweepstakes including, The Integer Group and each of their respective parent, subsidiaries or affiliated entities, distributors, dealers, dealer advertising associations, advertising and promotion agencies and any other agency that provides services in connection with this Sweepstakes, and the officers, employees and agents of each of the aforementioned.
HOW TO ENTER: During the Promotion Period, Entrants may enter one of two (2) ways:
ONLINE ENTRY WITH PURCHASE: To enter via this method of entry, submit your rebate claim at mobilpromotions.us/delvacrebate and choose yes when asked if you would like to be entered into the Sweepstakes.
NO PURCHASE NECESSARY: You may enter the Sweepstakes online at mobilpromotions.us/delvacrebate without making a purchase by completing the online form with your full name, address, city, state and zip code, day and evening telephone numbers (including area codes), date of birth and e-mail address. Sponsor will use e-mail addresses provided via the Entry only for purposes of notifying Winners, as specified below; however, eligibility to participate in the Sweepstakes is not dependent upon Entrant's provision of this information. Each Entry shall count as a single (1) entry.
Entries must be received by Sponsor no later than 11:59:59 PM CST on November 30, 2023 to be eligible for the random drawing. For purposes of this Sweepstakes, "receipt" of an online Entry occurs when Sponsor/Administrator's server records the entry information resulting from the Entrant selecting the "SUBMIT" button no later than 11:59:59 PM CST on November 30, 2023. Automated Entries (including but not limited to entries submitted using any robot, script, macro, or other automated service) are not permitted and will be disqualified. Entrants may not enter using multiple email addresses.
LIMIT: One (1) Entries per person, per mailing address/household or email address during the Promotion Period regardless of the method of Entry. Multiple Entries received during the Promotion Period from any person, household address or email address after the first online Entry received from that person, number, household address or email address will be void. Once submitted, an Entry cannot be deleted, canceled, or modified. All Entries become the property of the Sponsor and will not be acknowledged. Sponsor reserves the right, in its sole discretion, to void any and all Entries of an Entrant that submits more than the one (1) permitted Entries, or who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, or proper play of this Sweepstakes.
DRAWING AND ODDS OF WINNING: Two (2) winners of the Grand Prize, as specified below ("Winners") will be selected in a random drawing from among all eligible Entries received. Drawing will be conducted on or about December 15, 2023 by Administrator, an independent judging organization whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible Entries received. Decisions of judges are final.
GRAND PRIZE: Two (2) Grand Prizes: Each Grand Prize consists of a private fishing excursion for one (1) winner and their guest with Scott Martin, Professional Angler ("Grand Prize"). Total Approximate Retail Value ("ARV") valued at $5,000. Includes round-trip air fare for winner (and one (1) guest) from major airport closest to winner's home to Clewiston, FL (estimated roundtrip flight cost per ticket: $1000). The trip will include an all-day boating excursion with Scott leaving from Roland Martin Marina, as well as dinner with Scott (on his expense) the day before or day of excursion. Winner and guest will receive a $500 spending stipend for ground transport/meals and 2 nights hotel accommodations ($300 per night, 2 rooms.)The Grand Prize winners will also receive a merch gift guide comprising of hats, shirts, a tackle box as well as fishing rod and reel.
GRAND PRIZE CONDITIONS: Only the Grand Prizes specified above will be awarded. Grand Prizes are non-transferable. Winners agree to release the Sponsor and the Promotion Entities from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by Entering the Sweepstakes or for damages of any kind caused by the Grand Prize or resulting from acceptance, possession, or use/misuse of the Grand Prize awarded. No substitution or transfer of prize will be permitted, except at the sole discretion of Sponsor. The Grand Prize does not have a cash equivalent.
CLAIMING GRAND PRIZES: As a condition of winning a Grand Prize, Winner may be required to complete, sign and return, an Affidavit Of Eligibility and Release of Liability/Publicity Release (where legal) within ten (10) days of Grand Prize notification, or the Grand Prize will be forfeited and an alternative winner selected. The Winners will be contacted by an email sent to their email address that they used in their online Entry (in the sole discretion of Sponsor) or by U.S. Mail. If potential Winner does not respond within ten (10) calendar days from the first notification attempt an alternate Winner may be selected. In the event that a potential Winner does not respond to any such Grand Prize Notification within ten (10) calendar days of the date of issuance or declines the Grand Prize for any reason, a disqualification will result, the Grand Prize will be forfeited and, at Sponsor's sole discretion, an alternate potential Winner may be randomly selected from among all remaining eligible Entries received for the random drawing.
ADDITIONAL TERMS FOR THE SWEEPSTAKES:
TAXES: All winners with prize values of $600 or more must supply Sponsor and/or Administrator with their social security number. An IRS Form 1099 will be issued in the name of winner for the actual value of the Prize awarded if the actual value of prize is $600 or more. All federal, state and local taxes, and any other costs and expenses associated with acceptance or use of prize not specifically provided for in these Official Rules are solely the winner's responsibility.
GOVERNING LAW AND LIMITATION OF LIABILITY: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS' REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
USE OF DATA: Sponsor will be collecting entrants' personal data in accordance with the Sponsor's Privacy Policy that can be reviewed at the following link: http://corporate.exxonmobil.com/en/global-legal-pages/privacy-policy. Please see the full Privacy Policy for details. Entrant's personally identifiable information is not shared with third parties unless we give entrant prior notice and choice. Sponsor do not rent, disclose or share personal information or aggregated demographic information with our partners and advertisers. Though we may use an intermediary to conduct promotions, they may not use entrant's personally identifiable information for any secondary purposes. By participating in the Promotion, you hereby agree to Sponsor's collection and usage of your personal information and acknowledge that you have read and accepted Sponsor's privacy policy. Entrant's information will be used for purposes of direct marketing, research, and monitoring or improving the use and satisfaction of ExxonMobil's products.
GENERAL: Participating entrants agree to these Official Rules and the decisions of the Sponsor and the Sweepstakes Administrator, and release the Sponsor, the Sweepstakes Administrator, and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each (the "Released Parties"), from all claims and liability relating to their participation in the Sweepstakes, and the acceptance and use/misuse of the prize offered. Participating entrants assume all liability for and Released Parties shall be held harmless against any liability for any injury, losses or damages of any kind to persons, including personal injury or death, or injury to property caused or claimed to be caused in whole or in part, directly or indirectly, by participation in this Sweepstakes, acceptance, possession, or use/misuse of the prize, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.
In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof, to Sponsor's satisfaction, that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, entrant (i) agrees to be bound by these official rules, including all eligibility requirements, and (ii) agrees to be bound by the decisions of Sponsor and the Sweepstakes Administrator, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes.
Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor. If, for any reason, the Sweepstakes cannot be run as planned, Sponsor may disqualify any suspect entries or individuals from the Sweepstakes and any sweepstakes it sponsors and (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.
THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, EPIDEMICS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT, OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE, AS APPLICABLE. DISPUTES: The parties hereto each agree to finally settle all disputes only through arbitration; provided, however, the Released Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in Harris County, TX and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator's decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. ("JAMS") or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a "Demand for Arbitration", then either party can elect to have the arbitration administered by the American Arbitration Association ("AAA") or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Spring, TX. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn't apply and the dispute must be brought in a court of competent jurisdiction in Spring, TX. Sponsor agrees to pay the administrative and arbitrator's fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
SWEEPSTAKES RULES: These Official Rules will be posted on Sponsor's website at mobilpromotions.us/delvacrebate during the Promotion Period.
WINNERS LIST: To receive a Winners List, send an email to: winners@dja.com with "Mobil Delvac Fall CVL Sweepstakes (01-2586-10)" as the subject line. Requests must be received by January 31, 2024.
